01 Overview
These Terms of Service ("Terms") govern your access to and use of Build Sites ("Build", "we", "us"), an AI powered website creation platform operated by DVSCRIPTS., registered in Sheridan, United States. By creating an account, purchasing a plan, or using any part of the service, you agree to these Terms.
If you do not agree with any part of these Terms, you must not use the service.
02 Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Build. By using the service you represent that you have the legal capacity to enter into a binding agreement and that your use complies with all laws applicable to you.
03 Account registration
To use Build you must create an account with accurate and complete information. You are responsible for all activity under your account and for keeping your login credentials secure.
- One account per person or business unless we approve otherwise.
- You must notify us immediately of any unauthorized use of your account.
- We may suspend accounts that provide false information or violate these Terms.
04 Services overview
Build lets you generate, edit, host, and publish websites using AI, professional templates, and built-in business tools including blogs, analytics, inbox, chatbot, and custom domains. Features vary by plan and may change as the platform evolves.
05 Subscriptions, credits & billing
Paid plans are billed in advance on a monthly or yearly basis through our payment processor (Stripe). Plans include a monthly allowance of credits, which are consumed by actions such as generating a website, using a template, editing with AI, generating images, or writing blog posts.
- Credits refill on each billing cycle and unused credits do not roll over unless stated otherwise.
- Credits are consumed at the moment an action runs and are not returned if you discard the result.
- Prices may change; we will notify you before changes affect your next billing cycle.
- Failed payments may lead to downgrade or suspension of paid features.
06 Domains
Custom domains purchased through Build are registered with third party registrars on your behalf. Domain registrations take effect immediately and are non-refundable once registered, as the registration cost is incurred instantly. Domain renewals, transfers, and DNS behavior are also subject to the registrar's terms.
07 E-commerce & fulfillment
If you sell products or services through a website created with Build, you are the merchant of record for your customers. You are solely responsible for your products, pricing, taxes, shipping, refunds to your customers, and compliance with consumer protection laws. Build provides the website tooling only and is not a party to transactions between you and your customers.
08 Inbox integrations & email
Build can collect messages from your website visitors into your dashboard inbox and connect with email services. You are responsible for how you use visitor data and for complying with anti-spam and privacy laws when contacting people who message you through your website.
09 AI-generated content
Build uses artificial intelligence to generate website structure, text, and images. AI output can contain inaccuracies. You are responsible for reviewing and approving all generated content before publishing, including legal claims, pricing, and business information on your website.
- Similar prompts can produce similar results for different users; uniqueness is not guaranteed.
- You must not present AI output as professional advice (legal, medical, financial) without qualified review.
10 Ownership & rights
You own the content you upload and, to the extent permitted by law, the websites you generate with Build for your own use. We retain ownership of the platform, templates, software, and underlying technology. You receive a license to use templates and generated assets as part of your website; you may not resell templates as standalone products.
11 Refunds
Because Build delivers digital services instantly (AI generation consumes computing resources immediately, credits are usable at once, and domains are registered in real time), payments are generally non-refundable. 12 Exceptions
We may issue refunds or credits in specific cases such as duplicate charges, verified billing errors, or confirmed non-delivery of a paid service. Requests must be sent to admin@build-sites.com within 7 days of the charge and will be reviewed within 5 business days.
13 Analytics
Build provides visitor analytics for your websites. Analytics are provided for guidance and may differ from other measurement tools. If you use analytics, you are responsible for disclosing tracking to your visitors as required by applicable law.
14 Data protection
We process personal data as described in our Privacy Policy at build-sites.com/privacy. For data your websites collect from visitors, you act as the data controller and Build acts as a processor providing infrastructure.
15 Acceptable use
You agree not to use Build to create or distribute content that is illegal, fraudulent, deceptive, or harmful. Prohibited uses include:
- Phishing pages, scams, or impersonation of other businesses.
- Malware, spam campaigns, or content that infringes intellectual property.
- Hate speech, exploitation, or content illegal in the United States or your jurisdiction.
- Attempting to abuse, reverse engineer, or overload the platform or its AI systems.
We may remove content or suspend accounts that violate this section without prior notice.
16 Branding
Websites published on free plans may display a "Created with Build" badge. Paid plans can remove Build branding. You may not remove required branding through technical means on plans that include it.
17 Service availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance, upgrades, or events beyond our control may cause temporary downtime. We are not liable for losses caused by downtime, though we always work to restore service quickly.
18 Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI output will meet your requirements or that the service will be error free.
19 Limitation of liability
To the maximum extent permitted by law, DVSCRIPTS. shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
20 Indemnification
You agree to indemnify and hold harmless DVSCRIPTS, its officers, and employees from claims, damages, and expenses (including reasonable legal fees) arising from your websites, your content, your use of the service, or your violation of these Terms.
21 Arbitration & disputes
These Terms are governed by the laws of the State of Sheridan, United States. Any dispute that cannot be resolved informally shall be settled by binding arbitration in Sheridan, on an individual basis. You waive the right to participate in class actions to the extent permitted by law.
22 Termination
You may stop using Build and cancel your subscription at any time from your dashboard. We may suspend or terminate accounts that violate these Terms, abuse the platform, or create legal risk. Upon termination, your right to use the service ends; published websites on Build infrastructure may be taken offline.
23 Changes to terms
We may update these Terms from time to time. Material changes will be announced on this page with a new effective date, and where appropriate by email. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
